STEAMBOAT FIT MEMBER AGREEMENT

MEMBERSHIP CONTRACT AGREEMENT

This Membership Agreement (“Agreement” or “Membership Agreement”) is entered into between Steamboat Fit, LLC, located at 385 Anglers Dr., Suite C & D,  and 1901 Curve Plaza, Suite B, Steamboat Springs, CO 80487  (“Steamboat Fit”), and you the member. Steamboat Fit is a boutique fitness studio offering group fitness classes, reformer pilates, nutrition, personal training, and open gym. This Agreement entitles members access to participate in these classes and to enjoy other amenities offered including but not limited to: weight equipment, cardio equipment, and all other fitness equipment.

 

Please review this Agreement thoroughly as it is a legal contract between Steamboat Fit and all members. By using the services offered at Steamboat Fit, members are agreeing to the terms of this Agreement.

 

STEAMBOAT FIT 4-PACK CONTRACTS

This package is not a punch card. This package will automatically renew each month unless canceled. If you do not use all 4 visits within the 30-day period, any unused visits will expire and will not carry over to the next month or be refunded. Your agreement starts the day you purchase the package, This package will automatically renew each month, but can be canceled at any time. Cancellation requests must be submitted at least 10 days prior to the next scheduled monthly autodraft.

 

STEAMBOAT FIT 8-PACK CONTRACTS

This package is not a punch card. This package will automatically renew each month unless canceled. If you do not use all 8 visits within the 30-day period, any unused visits will expire and will not carry over to the next month or be refunded. Your agreement starts the day you purchase the package, This package will automatically renew each month, but can be canceled at any time. Cancellation requests must be submitted at least 10 days prior to the next scheduled monthly autodraft.

 

RESERVING CLASSES

Clients are solely responsible for the booking and canceling of their classes. Clients may reserve class spots online through their account, the MindBody application or by calling Steamboat Fit during normal business hours and confirming with studio staff.

 

SIGN-IN

Clients are required to enter their scheduled class no later than 5-minutes after the scheduled start time. If a client does not enter their classroom by this time, it is considered a no-show and Steamboat Fit reserves the right to assign the spot to another person on the waitlist, as well as charge a no-show fee (detailed below).

 

CLASS CANCELLATIONS

Reservations may be canceled without penalty by canceling up to 4 hours prior to the class start time. This may be done online via a client’s account, or by calling the studio during regular operating hours and confirming with studio staff. Once the class is canceled within this time, the class will be returned to the client's account, and the client will not be charged the cancellation fee.

Reservations for Pilates Reformer Classes may be canceled without penalty by canceling up to 12 hours prior to the class start time. This may be done online via a client’s account, or by calling the studio during regular operating hours and confirming with studio staff. Once the class is canceled within this time, the class will be returned to the client's account, and the client will not be charged the cancellation fee.

 

Cancellations via Facebook messenger, Instagram or other social media, text messages are not valid and the member will be charged.

 

Auto-renewing memberships without a long-term commitment can be canceled at any time without incurring a cancellation fee. However, notice of cancellation must be provided at least 10 days prior to the next billing cycle to avoid being charged for the following month. No refunds will be provided for failure to cancel after a billing cycle has completed. All cancellations will go into effect prior to the next upcoming billing cycle.

 

MONTHLY UNLIMITED MEMBERSHIPS

If you do not cancel within the 4-hour requisite window, a late-cancel fee of $10 will be charged to your account. If you do not cancel and do not show up to your scheduled class, a no-show fee of $10 will be charged to your account. If the card on file is declined when processing late-cancel or no-show fees, Steamboat Fit reserves the right to suspend your membership until payment is received. If you are on an auto debit contract or unlimited package and do not have a working card on file for such fees, your package will be reduced by one day and your auto debit contract will be suspended upon the subsequent month’s renewal.

 

The no-show and late-cancel fees apply to ALL clients equally regardless of unlimited status or special package pricing or membership level.

 

If you book multiple classes, or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy outlined above. Steamboat Fit staff cannot be held responsible for accidental bookings by clients, double bookings, or double waitlisted classes made by members. Late-cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy for double bookings.

 

Rates are subject to change during the term of this Agreement. Members will receive notification of any rate changes at least 10 days prior to the change. Notification will be sent via email, physical mail, newsletter, or the phone number listed in the client's profile.

 

PACKAGE PURCHASES

By purchasing a package from Steamboat Fit, you agree to the Terms and Conditions in full (see below). Packages cannot be shared between members. Unlimited and auto-debit contract members are required to keep a current credit card on file.

Specially priced expiring packages may not be extended, transferred, refunded, shared, or frozen. Packages that expire will activate on the first class either booked OR waitlisted.

CREDIT CARD ON FILE

Members may elect to keep a credit card on file using their Steamboat Fit account online. By placing a card on file, the cardholder and account holder gives permission to the Steamboat Fit staff to charge the card for any auto-debit packages and/or cancellation fees accrued in accordance with the Steamboat Fit, cancellation policy detailed above.

 

AUTO-DEBIT

By enrolling in an auto-debit contract, you authorize Steamboat Fit to, on a recurring basis, automatically charge the debit or credit card account you specified, for the monthly payments on your unlimited auto-debit plan associated with your account, on the billing due date. You understand and acknowledge that (1) Steamboat Fit will initiate transfers/charges pursuant to this authorization not to exceed the amount show on your Membership Agreement and/or in connection with cancellation fees per the cancellation policy. Steamboat Fit may discontinue processing of recurring charges if it is unable to secure funds from your debit/card due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information provided; (2) the Steamboat Fit booking system allows for booking through the week regardless of the billing date of your contract; (3) if you are booked in a class past the subsequent billing date, and your debit/credit card fails to bill properly, that you will be removed from any classes past the subsequent billing date and notified via electronic mail; (4) if you are removed from class due to the circumstances as described, it may not be possible to place you back into the class for which you were originally booked and that you will not be given any priority in waitlisted classes; (5) it is your responsibility to keep a current card on file with accurate billing information. Steamboat Fit cannot be held responsible for errors in processing due to expired or inaccurate information.

 

CONDUCT/DAMAGES

Steamboat Fit is committed to the health, safety, and welfare of each of its members and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behavior. Members who do not observe Steamboat Fits’ rules and regulations or who abuse equipment in any fashion will be asked to leave. Steamboat Fit has the right to judge behavior and respond accordingly. This right includes, but is not limited to termination of a membership without refund to any member engaging in unacceptable behavior. The member shall pay for any damages to Steamboat Fit property which results from the willful or negligent conduct of any member, member’s guest, or member’s dependent child. Not all rules and regulations are listed in this agreement. Steamboat Fit reserves the right to add, change, or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by Steamboat Fit. Members will be notified of any significant changes in advance where possible.

 

PHOTO/VIDEO RELEASE

You hereby grant Steamboat Fit, its representatives, employees, or agents the right to take photographs and video footage of you and your property while at Steamboat Fit and to use and publish these photos or videos in print and/or electronically. You agree that Steamboat Fit may use photographs or video footage of you with or without your name for any lawful purpose, including for such purposes as publicity, illustration, advertising and web content.  If you do not wish to be photographed or recorded, please notify Steamboat Fit in writing prior to participating in any activities.

 

MEMBERS RIGHT TO CANCEL

If you wish to cancel this contract, you may cancel by delivering or mailing a written notice to Steamboat Fit. The notice must say that you do not wish to be bound by the contract. The notice must be delivered to: Steamboat Fit at 385 Anglers Dr. Suite D or 1901 Curve Plaza, Steamboat Springs, CO 80487. If you cancel, Steamboat Fit will return, within ten days of the date on which you give notice of cancellation, any payments you have made, minus any outstanding fees or dues owed.

 

CANCELLATION POLICIES

If during the original term of this contract you relocate more than a 30 radius from this business, you may cancel this agreement by providing a 30-day written notice and proof of relocation in the form of a newly issued driver’s license or utility bill. Any pre-paid dues will be refunded, except for a cancellation fee of $100.00. If you die or become permanently disabled, you or your estate may cancel this contract by providing a written request and certifiable proof of death or disability. For permanent disability, your doctor must provide certification of the disability and state that you are unable to use the facilities. Any pre-paid dues will be refunded and no cancellation fee will be charged. The business reserves the right to cancel or suspend your membership privileges for any time for any reason. If such cancellation or suspension is due to a violation of Studio policies, violations of terms or due to damages rendered by yourself or your guest, you are subject to full responsibility of the terms of this agreement along with a $50 fee and any charges for repairs to damages made. If the business goes out of business, buyer may cancel by written notice. Any cancellation under this subset will receive a pro-rata refund of payments. 

 

If you wish to cancel this agreement for any other reasons, you must deliver or mail a 30-day written notice to the business. This notice must state you no longer wish to be bound by the contract and must be delivered to: Steamboat Fit at 385 Anglers Dr. Suite D or 1901 Curve Plaza, Steamboat Springs, CO 80487. A contract cancellation fee of $250 will be charged for early termination of a contract agreement. Auto-renewing memberships which do not require a commitment of a certain length, will not incur a termination fee.
 

MEMBERSHIP RATES

Membership rates are subject to change at the sole discretion of Steamboat Fit. Members will be provided with a minimum of 15 days' notice prior to any rate adjustments. Any changes in membership rates will not affect the length or terms of the existing contractual agreement. The member's obligations under the contract will remain in force for the duration of the agreed term, regardless of any rate modifications.
